NOMADYN Pre-Order Policy

This Pre-Order Policy governs all products sold on a pre-order basis by NOMADYN (“Company,” “we,” “our,” or “us”). By placing a pre-order, you agree to the terms below.

1. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction). Pre-orders may be limited to specific geographic regions as stated on the product page. NOMADYN reserves the right to refuse or cancel orders at its discretion.

2. Payment Terms

Pre-orders require a 50% deposit at checkout to reserve your order. The remaining balance will be charged automatically 2–3 days prior to shipment.

By placing a pre-order, you authorize NOMADYN to charge your payment method for the full amount due, including deposit and remaining balance. If the remaining balance is not paid by the stated due date, NOMADYN may cancel the order and retain the deposit.

3. Binding Nature of Pre-Orders

All pre-orders are final and binding. Deposits and full payments are non-refundable, except if NOMADYN fails to fulfill the order.

Pre-orders allow NOMADYN to allocate production resources and inventory. Cancellation rights are limited; orders cannot be canceled once production begins. If NOMADYN cannot fulfill a pre-order, deposits and payments will be fully refunded.

4. Pricing

Pre-order pricing is locked in at the time of purchase. NOMADYN reserves the right to correct pricing errors. In rare cases involving extraordinary cost increases (e.g., tariffs, supply chain disruptions), NOMADYN may notify customers of necessary adjustments before fulfillment.

5. Estimated Shipping & Delivery

Orders ship in the exact sequence they are received. Estimated fulfillment begins May 1st, 2026.

If you order multiple SKUs, each item will ship when its production is complete. A single flat shipping fee of $15 applies per order, regardless of the number of SKUs purchased.

You will receive a tracking number once your order ships.

All shipping dates are estimates only and are not guaranteed. Production delays, supplier issues, logistics disruptions, or other events beyond our control may affect timelines.
Customers will receive regular email updates on production progress and estimated shipping timelines.

6. Force Majeure

NOMADYN is not liable for delays caused by events outside our reasonable control, including but not limited to natural disasters, supply chain interruptions, war, government actions, labor disruptions, carrier delays, and acts of God.

7. Transfer of Risk / Shipping Liability

All products are shipped FOB Origin via our fulfillment partner in Colorado. Risk of loss and title transfer to the customer upon delivery to the carrier. NOMADYN is not responsible for loss, damage, or delay once the shipment has left our facility or 3PL. Claims for lost or damaged shipments must be made with the carrier.

8. Returns & Warranty

Standard NOMADYN return and warranty policies apply once the product has been delivered. Pre-order status does not alter warranty eligibility. Products damaged in transit must be reported promptly.

9. Promotions, Bonuses & Giveaways

Limited-time promotions (including free accessories, or other bonuses) are available while supplies last, limited to one per qualifying order, and subject to substitution with an item of equal or greater value at NOMADYN’s discretion. If a promotion is tied to order sequence (e.g., first 250 pre-orders per SKU), eligibility is determined by timestamp in our ordering system. Giveaways are subject to applicable laws and separate official rules where required.

10. Resale, Abuse of Program, and Dealer Protection

Pre-orders are intended for personal use or by authorized dealers only. NOMADYN reserves the right to cancel orders or restrict eligibility if we reasonably suspect bulk purchasing for unauthorized resale, manipulation of giveaways, discounts, or promotions, fraudulent activity or multiple accounts used to circumvent order limits, or any activity that may negatively impact NOMADYN’s authorized dealer network.

Authorized dealers may place pre-orders under specific terms agreed with NOMADYN, including minimum order quantities and pricing compliance. Orders that violate these terms may be canceled, and deposits forfeited.

11. Dispute Resolution & Chargebacks

Customers agree to contact NOMADYN support at hello@nomadyn.com to resolve any issue prior to initiating a chargeback or payment dispute. NOMADYN will make reasonable efforts to resolve concerns within 10 business days. Improper chargebacks for valid pre-orders that comply with this policy may be contested with supporting documentation, including customer acknowledgment of these terms.

12. Limitation of Liability

To the fullest extent permitted by law, NOMADYN’s total liability shall not exceed the purchase price paid for the pre-ordered product. NOMADYN shall not be liable for indirect, incidental, consequential, or punitive damages.

13. Governing Law & Arbitration

This agreement is governed by the laws of the State of Colorado, without regard to conflict of law principles. Any dispute that cannot be resolved informally shall be submitted to binding arbitration in Colorado. Each party shall bear its own legal fees unless otherwise determined by the arbitrator.

14. Product Use, Installation & Safety

By placing a pre-order, you acknowledge and agree that you are responsible for proper installation and use of NOMADYN products according to provided instructions.

NOMADYN is not liable for any injury, death, or property damage resulting from improper installation, misuse, modification, or failure to follow instructions. Pre-ordering does not waive your responsibility to exercise reasonable care in installing and using the product.

15. Product Guarantee

NOMADYN products purchased via pre-order are covered by our 1-year guarantee, which protects against defects in materials, workmanship, and finish. For full details, please see: nomadyn.com/pages/guarantee.

16. Customer Acknowledgment

By placing a pre-order, you acknowledge and agree that your order is binding, deposits are non-refundable (except if NOMADYN cannot fulfill the order), orders ship in the sequence received, flat $15 shipping applies per order, delivery dates are estimates only, you are responsible for proper installation and use of products, and you have read and accepted this Pre-Order Policy.
